PCIHIPAA’s Cyber Breach Liability Program* helps you respond and recover from a data breach or network security incident.
Through this exclusive program, your organization will have access to IT Forensic Investigators, Breach Counsel, and Data Recovery Experts to ensure the best outcome for your business.
* The Cyber Breach Liability Program includes $500,000 in Cyber Breach Insurance. Covered Entities and Business Associates that purchase OfficeSafe 360 or OfficeSafe HIPAA may Opt-Out of the Cyber Breach Liability Insurance. Upon purchase, the cost of the Cyber Breach Liability Insurance will be itemized and billed accordingly. Cyber Breach Liability Insurance is offered by a third-party provider. There is a $1,000 per incident deductible and certain policy conditions, limitations, exceptions, waiting periods and restrictions apply. This program does not apply to practices domiciled in New York or Indiana.
What coverages are offered in the Cyber Breach Liability Program*?
Network Security Liability
Potential coverage for Defense and Loss due to a Network Security Wrongful Act (examples include Hacker Attacks, Viruses, Data Theft, Denial of Service Attacks) which results in a lawsuit.
Potential coverage for Defense and Loss due to a Media Activity Wrongful Act (examples include Copyright/Trademark Infringement, plagiarism, piracy, defamation, libel, slander) which results in a lawsuit.
Potential coverage for Defense and Loss due to a Privacy Wrongful Act (examples include Personal Documents and Data Theft, Violation of a Privacy Law or Failure to comply).
Privacy Notification and Penalties Costs
Potential coverage for direct costs and expenses incurred, as a result of a Network Security or Privacy Breach, for the following: Notify affected individuals of the breach and provide them with credit monitoring and Identity Theft Restoration services, and where covered and insurable by law, privacy fines and penalties.
Confidential Information Extortion Costs
Potential coverage for direct costs and expenses incurred, as a result of a Network Security Breach, to pay for a credible extortion threat and ransom requested by an unauthorized third party. This may also cover the program’s hiring of an IT forensic security expert to assist with the investigation and handling of the incident.
Network/System Business Interruption
Potential coverage for loss of business income, as a result of an unforeseen Network or Computer System Interruption.
Confidential Information Recovery Costs
Potential coverage for direct costs and expenses incurred, as a result of a Network Security Breach, to restore and recover data that is damaged or destroyed by an unauthorized third party. This may also cover the services for an IT forensic security expert that is pre-approved or hired by the program.
Potential coverage for direct costs and expenses incurred, as a result of a failure to comply with the Payment Card Industry’s Data Security Standard, pursuant to a Card Processing Merchant Agreement.
